Victoria Sopilnyak took part in the second session of the IX International Forum on Intellectual Property (IPF 2023)

Based on her expert experience, Victoria spoke about the development of IP litigation practice over the past year, emphasizing that over the past year, there have been several interesting positions of the Supreme Court that have influenced the development of the relevant practice.

Among the court cases that she recommends paying attention to are cases No. 910/5028/21, No. 910/10855/20, No. 910/17860/21, and No. 760/4277/17.

Victoria Sopilnyak also spoke about the trends in IP practice in other jurisdictions, in particular, have considered several types of cases, namely:

- patent disputes regarding infringement of rights by generics,

- patent disputes regarding the scope of rights under the SPC,

- copyright (fair use),

- disputes in the field of emerging technologies, NFTs, and artificial intelligence. 

In addition, Victoria separately thanked all the experts thanks to whom the system worked and even in many cases effective protection of copyright holders was achieved, despite the difficult conditions in which Ukraine has been living for the last year.
