“Doubinsky & Osharova” asserted PJSC “Oschadbank’ right on “Sberbank” trademark


On September 21, 2016 Kyiv Economic Court of Appeal refused to PJSC "Sberbank" in satisfaction of the appeal case of early termination of the certificate of Ukraine on sign for goods and services " Sberbank" of PJSC "Oschadbank." The appeal case was filed on the decision of the Economic Court of Kyiv, where previously the court rejected PJSC "Sberbank" claim to PJSC "Oschadbank" and the State Intellectual Property Service of Ukraine.

On May 27, 2016 PJSC "Sberbank" filed the claim on the early termination of the certificate of Ukraine on sign for goods and services "Sberbank" for all services of 36 class of the International Classification of Goods and Services. Together with the legal department of the client, Agency's lawyers have gathered appropriate evidence confirming the use of the trademark in advertising, business documents, the Internet, as well as during the facilitation offers. The plaintiff's representatives tried to convince the court that the provided evidence is not appropriate, and the use of the trademark was unfair. In turn, the Court of Appeals agreed with reasoned and cogent arguments of the Agency's lawyers about plaintiff's groundlessness statements. Thus, PJSC "Oschadbank" has defended its right to the trademark "Sberbank" in Ukraine.
