Doubinsky & Osharova successfully has defended the rights of Toyo Tire & Rubber Co., Ltd. in the case regarding the recognition of the TOYO trademark as well-known in Ukraine, the termination of the infringement of the rights to the trademark and the redelegation of the domain name toyo.in.ua in favour of the Agency’s client. On June 16, 2017, the Solomensky district Court of Kyiv issued the decision to recognize the TOYO trademark as well-known in Ukraine for goods of class 12 of the International classification of goods and services: “automobile tires” as of June 1, 2003.
Doubinsky & Osharova has successfully proved the well-known status of the TOYO trademark in Ukraine, and has managed to prohibit the defendant from using the TOYO's well-known trademark in Ukraine in domain names and the Internet. Also, the Agency has obtained the redelegation of the domain name toyo.in.ua in favour of the Agency's client.
The interests of Toyo Tire & Rubber Co., Ltd. were represented by the partner of Doubinsky & Osharova Yaroslav Ognevyuk, as well as the lawyers Sergey Kochkarev and Petro Shpakovich.
