Doubinsky & Osharova has bene acting for Diageo Scotland Limited – the owner of the famous Captain Morgan rum, from unfair competition actions on the alcohol beverages’ market.
On June 12, 2017 Kyiv’s commercial court denied the claim, brought by the defendant against the decision of the Antimonopoly Committee of Ukraine on recognition of unfair competition actions with respect to Diageo Scotland Limited and imposing a fine. Earlier the Antimonopoly Committee of Ukraine has twice recognized the unfair competition actions and has imposed the relevant fines on the defendant. It is important to mention that the fines, imposed on the defendant for the committed unfair competition actions, reached higher than 14 000 000,00 UA hrn.
Currently, the above-indicated decisions of the Antimonopoly Committee of Ukraine came into legal force and are on the stage of executions in the proceedings, specified by the law.
