Doubinsky & Osharova is the General Partner of the key legal autumn event for IP professionals - IP UKRAINE NOW 2021! This year the main focus of the discussion was on the effectiveness of the IP reform: the work of the Appeals Chamber in the National Intellectual Property Authority system, the existing problems of protection against unfair competition of IP objects, the effectiveness of the IP protection system at the customs border and other equally important issues.
Victoria Sopilnyak, Partner of Doubinsky & Osharova moderated the second session of the forum dedicated to an extremely interesting topic - the functioning of the Appeals Chamber:
- new rules;
- the first results of the work;
- invalidation of intellectual property rights;
- ways of forming in Ukraine and the EU.
Among the participants of the discussion were - Maria Vasylenko, Director of the Department of Law and Methodology of Intellectual Property of Ukrpatent, Chairman of the Appeals Chamber; Oksana Zhmurko, Head of the Department for Ensuring the Activities of Collegiate Bodies of Ukrpatent; Inna Shatova, Deputy Head of the Department of Industrial Property and International Cooperation - Head of the Industrial Property Department of the Intellectual Property Development Department of the Ministry of Economy of Ukraine; Myroslava Koval-Lavok, associate at Baker McKenzie - Kyiv, and Yulia Prokhoda, member of the Board of the National Association of Patent Attorneys, director of INTELS-Ukraine, attorney-at-law, patent attorney of Ukraine.
Mykola Pototskyy, Counsel of Doubinsky & Osharova, attorney-at-law, patent attorney delivered a speech within the Intellectual Property Reform session, which was attended by representatives of the legislative, the executive and the judiciary power, well-known lawyers and patent attorneys. The panelists focused on key strategic issues: the establishment of the High Court on Intellectual Property and key issues of protection of rights, legislation in need of improvement and the results of parliamentary control over the implementation of changes to legislation of 2020, the establishment of the National Intellectual Property Authority.
Mykola Pototskyy outlined the key business expectations of the NIPA’s work: efficiency, predictability, digitalization, openness, simplification of registration procedures, expansion of analytical and information services, development of the sphere.
Based on the results of the forum, it was agreed to draft a resolution, which will be sent to government agencies and other organizations involved in the process of reforming the IP sector in Ukraine.
