On October 5, the round table discussion "Supplementary protection of inventions for medicinal product " was held by Doubinsky and Osharova, the Committee on Intellectual Property of UNBA, and the Department of Intellectual Property and Information Law of the Educational and Scientific Institute of Law of Taras Shevchenko National University of Kyiv.
The discussion was attended by leading IP specialists - representatives of the executive authority, court experts, lawyers, patent attorneys, scientists, and representatives of the national and international pharmaceutical business.
The participants discussed the critical gaps in the legislation that pharmaceutical companies face in their activities, which result in long-term processes that impact businesses negatively.
Victoria Sopilnyak, partner of Doubinsky & Osharova, focused on issues arising during consideration of disputes in court , namely, application of the provision of the Association Agreement (Article 220) as a rule of direct effect and non-extension to the owner of PTE of the right of the owner of the SPC.
Based on her own experience gained in representing clients before the court in similar cases, Victoria shared her opinion on debatable issues with the audience.
Mykola Pototsky, the counsel of Doubinsky and Osharova, moderated the discussion. He stressed the importance of involving representatives of the pharmaceutical business in such discussions, as it is necessary to understand the problems they face in their day-to-day operation and solve them together for the effective functioning of business in Ukraine.
All participants of the round table discussion agreed that there is a need to improve legislative norms by adopting additional regulations that would resolve controversial issues.
