Doubinsky & Osharova partner made the report at the conference “Theory and practice of forensic expertise in the sphere of IP in the age of reforms”

The conference “Theory and practice of forensic examination in the field of intellectual property in the era of reforms" was held on October 5, 2017. It was organized by the Intellectual Property Committee of the Ukrainian Bar Association in cooperation with the Scientific and Research Institute of Intellectual Property of the NALS of Ukraine and the Intellectual Property Committee of the Ukrainian Advocates Association.

During the conference, important theoretical and practical issues of the forensic examination in the field of intellectual property in the age of changes and transformation were discussed.

In particular, Victoria Sopilnyak made the report on “The practice of consideration of “pharmaceutical” IP objects cases’ in the context of application of special knowledge.” Victoria focused the audience's attention on the fact that the main point is the quality of the examination, and not the number of the expert opinions. In addition, the forensic examination should not be reduced to a technical set of actions in the dispute resolution, and should be appointed only if there is a real need for special knowledge. Victoria considered that the creation of the specialized IP issues court, which will include judges specializing in "intellectual" cases, will ensure the same practice, including the need to appoint the forensic examinations in this category of cases.
