Forensic examinations in IP disputes

The characteristics of intellectual property objects explain some features of the procedure for resolving IP disputes and require the involvement of professional expertise.

In his lecture being a part of the unique course “Complex IP Protection”, held on September 6-8, at the Legal High School, Anton Koval outlined the key features of legal expertise, including criminal proceedings for intellectual property crimes, namely:

  • directions and tasks of legal expertise in IP disputes;
  • what knowledge should forensic experts have and where to order a qualified examination;
  • grounds for the examination: at the request of the party to the case and appointment of the examination by the court;
  • peculiarities of the examination appointed by the court

Anton supported his speech with relevant examples from his own practice and provided conclusions on the usefulness and feasibility of applying sound conclusions of professional experts in IP disputes.
