The life of a trademark application after the refusal of examination in Ukraine

On May 31, Tatyana Shpakovich, senior partner of Doubinsky and Osharova, participated in the weekly online meeting “Ask NAPA” organized by the National Association of Patent Attorneys.

Tatyana talked about "The life of a trademark application after the refusal of examination in Ukraine". In her speech, she focused attention on the grounds for refusing to grant legal protection to trademarks, examining in detail practical cases of both absolute and relative grounds, the arguments of the parties, and the strategy of action in specific cases.

Tatyana also highlighted the issue of contracts for transferring rights to "disputed" registrations, their features, and provisions that require additional attention from the parties to avoid grounds for refusal. Additionally, she offered practical advice on effectively concluding such contracts.

The audience's attention was separately focused on the legal advantages of a trademark coexistence agreement against a letter of trademark consent registration.
