Meeting with representatives of the National Intellectual Property Authority

On October 27, 2021, partners of Doubinsky & Osharova Tatyana Shpakovich and Victoria Sopilnyak, patent attorneys Olga Leonchyk and Taras Makitruk, as well as leading patent specialist Kateryna Vaisberh met with representatives of the National Intellectual Property Authority.

The main purpose of the meeting was to discuss the difficulties the NIPA’s experts, applicants and their representatives are facing in practice in applying the provisions of Part 21 of Article 16 of the Law of Ukraine "On Protection of Rights to Inventions and Utility Models" after legislative changes in 2020.

The situation requires the development of a balanced approach to solving the problem of law enforcement, aimed at creating a unified, transparent, properly regulated and predictable for the parties of the process of acquisition of legal protection of rights to inventions, which would take into account the interests of applicants, their representatives and NIPА and ensure the effective functioning of the system of protection and enforcement of intellectual property rights in Ukraine.
